How this estimate is calculated
Stamp duty on a Power of Attorney is governed by Article 48 of Schedule I of the Maharashtra Stamp Act, 1958. This calculator covers a POA given without any consideration, which produces one of two outcomes:
- ₹500 flat for any purpose other than selling immovable property (buying, leave & license, society, court, or banking matters), whoever the agent is; for a right that only lets the agent admit execution of a deed the owner has already signed; or for a near relative given the right to execute/sign a sale.
- Full Conveyance Deed stamp duty where a non-near-relative or friend is given the right to execute/sign the Conveyance Deed for a sale. This calculator does not compute that figure here; it directs you to contact us instead, since the charge is calculated the same way as the conveyance deed.
Rights granted matter when the agent is a non-near-relative or friend. A right to only admit execution stays at the flat ₹500 rate. A right to execute/sign the deed attracts full Conveyance Deed stamp duty.
Near relative is defined narrowly for this purpose: father, mother, brother, sister, wife, husband, son, daughter, grandson, granddaughter, and the father, mother, brother or sister of the spouse. Uncles, aunts, nephews, nieces, cousins and friends fall outside this list.
Registration fee: ₹100, applicable wherever the stamp duty is ₹500.
Document Handling Charge: ₹40 per page of the document, payable in addition to stamp duty and the registration fee.
A Power of Attorney given for consideration, or a Development Agreement cum Power of Attorney given to a builder, is not covered by this calculator and needs individual review. Figures here are indicative estimates only.
