Rent Agreement Registration in Pune — Online & Offline Leave and License Registration
Overview
If you’re renting out or getting a property on rent in Pune, the agreement you sign is almost always a Leave and License Agreement, not a lease, and under Maharashtra law, it must be registered, no matter how short the tenure. With 17 years of conveyancing experience in Pune, I handle both online e-registration (biometric, from home or office) and offline registration at the Sub-Registrar office, including remote registration support for NRI landlords and tenants.
Is Registration Compulsory for an 11-Month Rent Agreement Too?
Yes, and this is the point most people (and several websites) get wrong.
Under Section 55(1) of the Maharashtra Rent Control Act, 1999, every leave and license agreement, and this applies notwithstanding anything else in the Act or any other law, must be in writing and registered under the Registration Act, 1908. There is no minimum-duration exemption. Even a standard 11-month agreement, or a month-to-month arrangement, must be registered. This is the opposite of the general rule under the Registration Act (which only requires registration for leases beyond a year). Maharashtra specifically overrides that for rentals.
Registration is the landlord’s legal responsibility (Section 55(2)). If the landlord doesn’t register it:
- The agreement carries no evidentiary weight if a dispute goes to court, and worse, in the absence of a registered agreement, the tenant’s version of the terms is presumed correct unless the landlord proves otherwise.
- The landlord can be prosecuted under Section 55(3), with imprisonment up to 3 months or a fine up to ₹5,000, or both.
- An unregistered or notarised-only agreement is frequently rejected as address proof for bank KYC, police verification, or utility connections.

Because the online system registers the document in the department’s own template, anything beyond routine rent, deposit, and notice-period terms has to fit into that 1,000-character custom-clause field. For most residential rentals that’s not a real constraint. For commercial leave and license agreements which often carry detailed clauses on maintenance, fit-out, lock-in period, exclusivity, or termination clauses, offline registration gives the room to draft the agreement the way the parties actually negotiated it, rather than compressing it to fit an online form.
Maharashtra’s registration process now runs on the Leave and License 2.0 system (rolled out April 2025), alongside the earlier e-filing portal. Both require Aadhaar-based identity verification for the licensor, licensee, and two witnesses, and payment of stamp duty and registration fee online through GRAS (Government Receipt Accounting System). Where a client doesn’t have the biometric hardware, I arrange doorstep e-registration.
Registering as an NRI — What Actually Trips People Up
The deciding factor for NRI landlords and tenants is not location; it’s whether you hold a valid Aadhaar card.
If you have Aadhaar: the Maharashtra e-registration system is built to run “anywhere, anytime”. You can complete biometric/Aadhaar-linked verification and registration entirely from abroad, without visiting Pune or the Sub-Registrar office. I coordinate this remotely with clients based overseas.
If you don’t have Aadhaar (common for NRIs who left India before Aadhaar enrolment became universal, or who have never enrolled), remote e-registration isn’t available to you directly. In that case you have two realistic options:

- Time a short visit to Pune around the registration: if you’ll be in the city even briefly, I can complete drafting, stamp duty payment, and the full registration in a single sitting.
- Enrol for Aadhaar as an NRI: NRIs holding a valid Indian passport can apply for Aadhaar at an enrolment centre (a one-time in-person step), after which future registrations can be done remotely.
A notarised agreement is not a substitute in either case; it doesn’t meet the Section 55 registration requirement and won’t hold up the same way in a dispute or be reliably accepted as address proof.
How Stamp Duty Is Calculated
Under Article 36A, Schedule I of the Maharashtra Stamp Act, 1958, stamp duty on a leave and license agreement (for terms up to 60 months) is:
0.25% of — (Total rent for the entire term) + (any non-refundable deposit) + (10% notional annual interest on the refundable security deposit, for each year of the term)
Example: ₹25,000/month rent for 24 months, refundable deposit ₹5,00,000
- Rent: ₹25,000 × 24 = ₹6,00,000
- Notional interest: 10% × ₹5,00,000 × 2 years = ₹1,00,000
- Total: ₹7,00,000
- Stamp duty: 0.25% of ₹7,00,000 = ₹1,750
Registration fee (separate from stamp duty): ₹1,000 for property within Pune Municipal Corporation and PMRDA limits, ₹500 for rural areas.

Is it mandatory to register a rent agreement in Pune even for 11 months? Yes. Section 55 of the Maharashtra Rent Control Act, 1999 requires registration for every leave and license agreement regardless of duration — there’s no exemption for short-term or 11-month agreements.
